In this article, Judge Anthony J. Battaglia examines the new Rule 107 of the Federal Rules of Evidence. Judge Battaglia discusses the distinction between demonstrative evidence and illustrative aids under the December 1, 2024 amendments to the Federal Rules to help practitioners plan and present certain types of physical evidence.

San Diego FBA and the U.S. District Court for the Southern District of California are pleased to present the Judith N. Keep Federal Practice Seminar. This year we will celebrate the twentieth anniversary of the Keep Seminar and feature welcome remarks, a special video tribute to Judge Keep, a keynote address from Administrative Presiding Justice Judith McConnell of the California Court of Appeal, and panel presentations by several Southern District of California District Judges and Magistrate Judges. The panels will focus on various aspects of pretrial and trial practice, including civility and ethics in high-stakes litigation, best practices for mediation before Magistrate Judges, motion practice in federal court, and evidentiary rules at trial.

The Department of Justice launched its Civil Cyber-Fraud Initiative in October 2021. What has happened the last three years? The panel on October 23 from 9 to 10 a.m. will discuss lessons learned during the infancy of the initiative, including the type of cases that have led to FCA recoveries, paths to establishing fraud, the theories to quantify damages, and some of the relevant regulatory regimes. The panel will also discuss self-reporting considerations and what to look for in the future.

 

This program on October 24 from 11 a.m. to 12 p.m. examines how antitrust agencies in the U.S. and EU are addressing competitive effects in AI and Generative AI markets. Among topics to be covered are investigations, new and pending statutes and regulations, and international cooperation efforts. The audience will come away with an understanding of recent developments and practical advice for clients.

 

More than a year ago, the Supreme Court in SuperValu substantively addressed the False Claims Act’s scienter element, holding that scienter refers to a particular defendant’s knowledge and subjective beliefs, not to what an objectively reasonable person may have known or believed. This panel on October 30 from 9 to 10:30 a.m. will examine how lower courts have interpreted and applied SuperValu, trends in those decisions that may impact how False Claims Act cases are pursued and defended, practice pointers, and open issues to be decided.

Join the Immigration Law Section on November 6 from 9 to 10 a.m. Panelists, Kevin A. Gregg, partner of Kurzban Kurzban Tetzeli and Pratt P.A., and host of the weekly immigration case law podcast Immigration Review, and Brad Banias, federal court immigration litigator and former DOJ trial attorney, will discuss the impact of the Supreme Court’s recent decision in Loper Bright Enterprises v. Raimondo on immigration litigation.

 

This panel on November 6 from 11 a.m. to 12 p.m. will discuss the recent, rapid, and major developments in the field of non-competes. The FTC was expected to enforce its final rule on non-competes in September of 2024 before litigation prevented its roll out. Both corporate defense attorneys and plaintiff’s attorneys should be keenly interested in hearing the ins and outs of these new developments and what the state of the current litigation means for their clients.

Bankruptcy lawyers are expected to know the Federal Rules of Bankruptcy Procedure and a bankruptcy court’s local rules. Less known are the Federal Rules of Procedure and Evidence. This webinar on November 12 from 11 a.m. to 12 p.m. will focus on rules and evidence that apply in adversary proceedings and contested matters in bankruptcy court.
